Refusal of Abnormal Goods

Safety Agreement for Container International Railway Intermodal Transport
In order to ensure the safety of container international railway intermodal transport and cargo, prevent all kinds of accidents and eliminate potential safety hazards, this agreement has been signed through consultation between Party A and Party B in accordance with the Safety Production Law of the People's Republic of China, the Regulations on Railway Safety Management, the International Association and other relevant provisions on railway transport and railway safety management.
Party A's responsibilities:
1. Party A shall implement the national laws and regulations on railway transport safety, and the relevant rules and regulations on the safety management of container railway transport industry, so as to raise awareness of railway transport safety in compliance with laws and regulations and ensure the safety of container railway transport.
2. Before loading the containers consigned by Party A at the railway station, Party A shall inspect the condition of the containers, the name of the goods, the documents, the loading and reinforcing plan and the sealing situation.
3. Party A shall inspect whether the goods meet the requirements of railway transportation according to the list of dangerous goods on railways, and shall provide non-dangerous certificates issued by railway accredited appraisal bodies for goods whose names and physical and chemical properties are unknown.
4. Party A shall not perform the following acts when transporting containerized goods:
(1) To falsely report the name and nature of the goods;
(2) To carry dangerous goods in ordinary goods or prohibited goods in dangerous goods;
(3) Concealing or falsely reporting the weight of the goods or loading or packing more than the prescribed weight;
(4) Other acts that may endanger the safety of railway transportation.
5. The containers shipped by Party A shall not be transported without authorization: goods likely to contaminate or corrode the containers; goods liable to damage the containers; fresh and perishable goods; explosives, drastic drugs, radioactive goods, compressed gases and liquefied gases, goods whose physical and chemical properties interact with each other, and all kinds of dangerous goods.
For example, goods requiring special transport conditions, dangerous goods (explosives, compressed and liquefied gas goods, flammable liquid goods, flammable solid goods, flammable goods, goods that emit flammable gases when exposed to water, oxidizing goods, organic peroxide goods, toxic goods, infectious goods, radioactive goods, corrosive goods and other dangerous goods) ) At the same time, the two sides will agree separately on the feasibility and technical scheme of cargo transportation.
6. Party A shall examine and verify the loading and reinforcement plan of container cargo and confirm that it conforms to the relevant provisions of railway transportation. The cargo in the box should be stable and evenly loaded, so as not to overload, not to collect weight, not to unbalance load. Measures should be taken to prevent cargo from moving, rolling or collapsing when opening doors to ensure the safety of cargo and container transportation in containers.
For large and irregular cargo loaded with different cargo, such as locomotive wheels, locomotive wheel pairs, coils, copper plates, castings, machinery and equipment, if there is a consolidation plan for fixed loading, Party A shall load and reinforce according to the published consolidation plan; if there is no consolidation plan for fixed loading, Party A shall issue a consolidation plan for loading after examination at departure or entry stations.
7. The goods that Party A entrusts Party B to transport on its behalf shall be packaged and containers to prevent damage to the goods in transit and during replacement.
8. For goods under different transport conditions and goods that cannot be transported by mixtures according to the nature of the goods, no mixtures shall be allowed.
9. The self-contained containers entrusted by Party A to Party B for transportation must meet the requirements of container railway transportation. No scrap containers, damaged containers and other types of containers that do not meet the railway transport standards are used. The self-contained containers used must have the container certificate of the classification society. Containers with a container age of 8 years or less should be used.
When transporting goods in non-20 or 40-foot general standard containers, Party B shall be provided with technical parameters of containers 15 working days before shipment to confirm the conditions of transportation and to negotiate.
10. According to the requirements of railway station, the photos taken during loading (including at least empty box photos, half-time photos of loading goods, photos when filling goods, photos when opening the left door and closing the right door after filling, photos after closing the box door) must clearly reflect the sealing, unlocking situation and lock rod, door handle tightening and bolt intact state after sealing. The packing photos are provided to Party B for examination and preservation before departure.
11. Party A shall confirm the validity of sealing after sealing the box door. There are no problems such as damage of the box body, failure of reinforcement bolts of the door handle and so on.
12. If Party A manufactures its own waybill, Party A shall carefully check the whole set of documents, requiring that the documents be consistent with the goods and documents, and that the contents of the waybill should be consistent with the accompanying documents, so as to ensure that the standard of waybill filling-out meets the relevant requirements of the International Association.
13. When goods are transported in 20-foot boxes through the Central European Band Line, the weight of the loaded goods shall not exceed 23 tons (if there are other loading weight restrictions at the station, they shall be carried out according to the requirements of the station). When two 20-foot boxes are consigned on the same truck, the difference in weight between the two boxes shall not be greater than 5 tons (if the station has other requirements, if less than 5 tons, the difference shall be implemented as required by the station).
Party B's Liability
1. Publicize and clarify the relevant regulations of railway transportation and railway safety management to Party A so that Party A can comply with them.
2. Provide containers in good technical condition according to Party A's requirements.
3. Cooperate with Party A to do a good job in the safety inspection of the goods of the Container League of Nations, and put forward corrective suggestions on the potential safety hazards of Party A in the aspects of cargo loading and container use.
4. Party B shall timely inform Party A of safety accidents or potential safety hazards during transportation and assist Party A in solving related problems.
5. If Party B manufactures its own waybill, Party B should carefully check the whole set of documents, requiring the same waybill and documents, and the contents of the waybill should be consistent with those of the accompanying waybill to ensure that the waybill is filled in.
